Advanced Disposal Litigation

The Advanced Disposal litigation focused on pollution emanating from a southeast Alabama landfill. There were two major components to the litigation: 1) obtaining relief for citizens that lived near the landfill, and 2) obtaining relief for users and consumers of polluted water as a result of “pass through” contamination from a lagoon system that was not designed to treat industrial leachate. We were able to establish that leachate-based contamination had invaded the properties of our clients as well as the water supply downgradient of the pollution. The case went up to the Alabama Supreme Court twice on joinder issues. We ultimately prevailed on these issues and successfully mediated the case. After five years of litigation through the COVID-19 pandemic, we were able to obtain a favorable result for our clients in the form of a confidential settlement.
