Ongoing PFAS Litigation in Muscle Shoals and Colbert County, Alabama

FPC is proud to represent the City of Muscle Shoals, Alabama, the Muscle Shoals Utilities Board, Colbert County, Alabama, and the Colbert County Water Department in pending litigation against 3M, Daikin, Toray, and BFI Waste Systems. Muscle Shoals and Colbert County supply drinking water from the Tennessee River, which has been impaired by PFAS pollution stemming upriver. While the cases remain ongoing, FPC attorneys successfully argued before the Alabama Supreme Court that the cases should be heard by the Circuit Court of Colbert County, defeating the Defendants’ attempts to move the litigation to Morgan County, where much of the PFAS pollution originated. FPC remains diligent in their efforts to provide the citizens of Muscle Shoals and Colbert County safe drinking water that fully complies with changing federal drinking water standards.
